Terms of Service Effective Date: April 15, 2022 Version: 22.1 By using the services of SLOPE PLANNING (hereinafter “the Site”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to any part of these Terms, you may not use the Site’s services. Article 1: Relationship Between You and the Site These Terms apply to transactions between you and the Site regarding travel plans and other tourism experiences (collectively “Tourism Services”) provided by the Site or other suppliers (“Suppliers”) through the reservation system on the Site (“the Platform”). Such services via the Platform are referred to as “the Service.” These Terms constitute the agreement (“Service Agreement”) governing your use of the Service. By using any part of the Service, you agree to be bound by these Terms, the Site’s Privacy Policy, and any other conditions applicable to the relevant service as posted on the Platform or provided offline. All such conditions form part of the Service Agreement (collectively “Terms and Conditions”). The Site may amend or update these Terms at any time without prior notice to you, as required by law or deemed necessary by the Site, in accordance with Article 548-4 of the Civil Code. Updated Terms will be posted on the Platform (slopeplanning.rezio.shop) with the last updated date. Continued use of the Service after updates constitutes acceptance of the revised Terms. Please review the latest Terms before using the Service. Article 2: Scope of the Service The Service allows you to easily select, reserve, and purchase Tourism Services provided by the Site or Suppliers via the Platform. You may only use the Service for personal, non-commercial purposes and must not resell or use the Service for profit. Upon confirmation of your reservation/purchase of a Tourism Service via the Platform, a contract for the use of that Tourism Service is formed between you and the Site, or you and the Supplier, as indicated on the Platform. While the Site endeavors to maintain and operate the Service and Platform, it does not guarantee uninterrupted or error-free operation. You agree that the Site may refuse access, modify, suspend, or terminate the Service or Platform at any time. Article 3: Platform Content “Platform Content” means all materials (text, photos, graphics, images, videos, audio, data, code, etc.) published or used by the Site on the Platform. You acknowledge that all Platform Content is owned by the Site or its licensors (collectively “the Site Parties”) and protected by intellectual property laws. The Site may modify, amend, or delete Platform Content without notice. Subject to your compliance with the Terms and Conditions, the Site grants you a limited, non-exclusive, non-transferable license to access and use the Platform. The Site may revoke this license at any time without notice. You agree to use Platform Content only for personal, non-commercial purposes and in compliance with applicable laws. You must not copy, reproduce, distribute, transmit, sell, or create derivative works from Platform Content, nor download or store it in bulk. You bear all risks arising from your use of or access to Platform Content. To the fullest extent permitted by law, the Site disclaims all liability for errors or omissions in Platform Content. You are solely responsible for any loss or damage to third parties caused by your use of Platform Content. You acknowledge that the Site cannot identify or control third parties you interact with via the Platform and cannot guarantee the accuracy or reliability of content provided by third parties. Article 4: Handling of Information Provided by You You consent to the Site’s use of your personal information in accordance with the Privacy Policy. The Site may request reviews of Tourism Services via SMS, email, or the Platform to improve the Service. Providing a review is optional. Upon receipt, the Site may upload your review to relevant Platform pages to share your feedback (but is not obligated to do so). Reviews must not contain misleading, inappropriate, defamatory, threatening, or offensive language, personal information, unrelated content, or violations of laws or the Terms and Conditions. By submitting a review (including text, photos, images, videos), you grant the Site, Suppliers, the Platform provider, and Platform users an irrevocable, non-exclusive, royalty-free, worldwide, sublicensable license to use, modify, quote, adapt, translate, create derivative works, or otherwise exploit the review (including for promotional purposes). You also grant Platform users a non-exclusive license for non-commercial use via the Platform. This does not affect your ownership of the submitted information unless otherwise agreed in writing. You warrant that all information you provide complies with laws, does not infringe third-party rights, and does not violate the Terms and Conditions. You are fully responsible for your submitted information, and the Site is not liable for any errors or omissions therein. The Site may, at its discretion, remove any review or information you provide from the Platform without objection from you. Article 5: Your Representations and Warranties You are solely responsible for your use of the Service, Platform, and Tourism Services and must fully comply with the Terms and Conditions. You warrant that you will: (a) Not copy, reproduce, distribute, or transmit any part of the Service without the Site’s prior written consent (including modifying software or using Platform Content). (b) Not bypass, damage, or interfere with the Service’s security or access it in unintended ways. (c) Not decompile, reverse engineer, hack, or access the Service/Platform beyond permitted uses. (d) Not mirror, frame, or display the Service on other applications/websites without authorization. (e) Not access non-public areas of the Site’s or its providers’ systems. (f) Not harass, abuse, or harm the Site, Suppliers, their staff, or other users. (g) Not provide false personal information or impersonate others. (h) Not request personal information from other Platform users. (i) Not restrict others’ use of the Service or disclose their information without consent. (j) Not use the Service for commercial advertising unless expressly permitted. (k) Not engage in fraud, security breaches, or illegal activities. Article 6: Order Confirmation and Refund Policy You may select and reserve/order Tourism Services via the Platform in the designated currency. Unless explicitly confirmed immediately, reservations/orders require subsequent confirmation of availability by the Site or Supplier. You agree to receive confirmation via SMS, email, or app. Indicated confirmation times are estimates only. The Site may change prices at any time, with notice via the Platform, SMS, email, or app. Continued use after notice constitutes acceptance of new prices (except for confirmed reservations/orders). The Site may refuse or cancel your reservation/order without notice if you violate the Terms and Conditions. You agree to pay via the Site’s designated methods. The Site is not obligated to provide Tourism Services until payment is complete. Unless otherwise stated, payments are non-refundable. For Supplier-provided Tourism Services, the Supplier may accept or reject your reservation/order at its discretion. Upon acceptance, a contract is formed between you and the Supplier. The Supplier is solely responsible for service delivery; the Site is not liable. Contact the Supplier directly for service inquiries, though the Site may assist in resolution. Additional taxes/fees may apply and must be paid directly to the Supplier or authorities. The Site requires accurate Supplier information but does not guarantee its completeness. The Site will notify you promptly if a Supplier cancels your order. Refunds (via the original payment method) are issued if: (i) you cancel per the displayed policy, or (ii) the Site/Supplier cancels due to unmet conditions. You acknowledge refunds may vary due to exchange rates or card/processor fees. E-Voucher Use (1) Upon confirmed reservation/order, you receive an E-Voucher (electronic voucher) via SMS/email (unless a physical voucher is provided). Print and present the E-Voucher at the service location. (2) You must comply with E-Voucher conditions (e.g., arrive on time, present ID/order number). Failure to comply forfeits the service with no refund. (3) The Site/Supplier is not obligated to reissue lost/stolen E-Vouchers or provide services. Use in violation of conditions or laws allows refusal of service with no refund. Article 7: Limitation of Liability You acknowledge that Platform Content may come from Suppliers/third parties, and the Site makes no warranties as to its accuracy. You agree not to hold the Site liable for such content. You accept the risk of third-party interception of Platform communications. The Site is not responsible for Platform information security. The Site, Suppliers, their officers, and agents are not liable for damages caused by your breach of the Terms and Conditions or use of the Service/Platform/Tourism Services, except in cases of the Site’s intentional or gross negligence. Your sole remedy for dissatisfaction is to stop using the Service. To the fullest extent permitted by law, the Site’s maximum liability is limited to the total amount you paid to the Site and Suppliers in the 12 months prior to your claim. Article 8: Indemnification You are responsible for resolving, at your cost, any disputes with third parties arising from your breach of the Terms and Conditions or use of the Service/Platform/Tourism Services, including intellectual property infringements. You will indemnify the Site, Suppliers, their officers, and agents for any resulting damages (including legal fees). The Site may require you to defend, take legal action, or negotiate settlements in such disputes. You must report dispute status to the Site and not take actions contrary to the Site’s interests without prior written consent. Article 9: Termination The Site may suspend your access to the Service/Platform or deactivate your account without notice if you breach the Terms and Conditions or if the Site deems it necessary. Article 10: Visa and Insurance You are responsible for verifying entry regulations for your destination, regardless of nationality. Requirements may change without notice—check before departure. For your protection, consider comprehensive travel insurance before departure, depending on the Tourism Service. Article 11: Dispute Resolution The Terms and Conditions and your relationship with the Site are governed by the laws of the jurisdiction where the Site’s office is located. You agree that the court of first instance in that jurisdiction has exclusive jurisdiction over disputes arising from your use of the Service/Platform/Tourism Services. Article 12: Miscellaneous If any provision of these Terms is invalid, illegal, or unenforceable, the remaining provisions remain valid. The Site may assign its rights/obligations under the Terms and Conditions. You may not assign your rights/obligations without the Site’s prior written consent.
